Kota Kinabalu: Two men charged with trafficking 2,114.7gm of syabu were ordered to enter their defence.
High Court Judge Amelati Parnell made the order against Mohd Haffiz Nizam Mohd Amin, 32, and Suhendra Sundu, 34, after ruling that the prosecution had established a prima facie case.
Haffiz and Suhendra’s defence was fixed for Feb 28-29.
The duo who are friends, were jointly accused of trafficking the drug at 2.50pm on July 1, 2021 by the roadside in front of the Posstore Shop at Lorong Suria Inanam 3, Suria Inanam 3.
They were charged under Section 39B(1)(a) of the Dangerous Drugs Act 1952, which carries a punishment with either the death penalty or life in prison and whipping with a minimum of 15 strokes.
The prosecution had called nine witnesses during the hearing.
Deputy Public Prosecutor Azreena Yaz conducted the prosecution while the duo were represented by counsels Hairul Vyron and Luke Ressa Balang.
