Kota Kinabalu: A 41-year-old food seller who used forged documents as genuine for a late birth certificate application was sentenced to three months’ jail and fined RM2,000 or three months’ jail.
Magistrate Lovely Natasha Charles meted out the sentence to Erdawaty Zulkarnain due to the seriousness of the offence.
Erdawaty pleaded guilty to using as genuine a child health record card, antenatal card and baby birth card at 11.30am on Oct 5 this year at the National Registration Department (NRD), in the Sabah Federal Government Administration Complex here.
She had committed an offence under Section 471 of the Penal Code, punishable under Section 465 of the same Code, which carries a jail term of up to two years or fine, or both, on conviction.
The court was informed by the prosecution that Erdawaty was at the NRD to apply for late registration of birth for her two children and had submitted the said forged documents.
It was later found that the said documents were dubious and suspected to be fake.
Investigation revealed that the documents were not issued by the government clinic but they were given by Erdawaty’s friend, said the prosecution.
Erdawaty was then handed to police, the court heard.
Unrepresented, Erdawaty requested leniency by saying that she has six children, earned only RM70, has a health problem and that her husband has another wife.
The prosecution applied a reasonable sentence.
In another case, a 25-year-old jobless man claimed trial to shoplifting.
Adzrol Blar was accused of stealing RM2.50 worth of a keychain at the 100% Mart in Sinsuran here at 1.50pm on Oct 4.
The charge is framed under Section 380 of the Penal Code which carries a jail term of up to 10 years on conviction.
The prosecution applied for a pre-trial case management (PTCM)
The court set Nov 20 for PCTM and released Adzrol on an extended bail of RM2,000 in two sureties.
