Kota Kinabalu: Two men who had been sentenced to death for murder had their sentences changed to jail by the Federal Court, Wednesday.
The justices, Datuk Rhodzariah Bujang, Datuk Nordin Hassan and Datuk Abdul Karim Abdul Jalil were unanimously in their decision.
Mohd Azmin Lidin, 36, was jailed 33 years and ordered given 12 strokes of the cane for killing Yaacob Nasran, 18, at between 3.30am and 4.30am on Dec 15, 2016 outside the Siam Thai Bar in Jalan Asia City, Star City, here.
The court ordered Mohd Azmin to serve the jail sentence from Dec 16, 2016. He was sentenced to death by the High Court on May 17, 2018 and the Court of Appeal had retained the jail sentence on May 13, 2019.
Earlier, the prosecution informed that the accused’s representation letter to substitute the mandatory death penalty sentence to imprisonment was accepted in view of the Abolition of Mandatory Death Penalty Act 2023 in condition that the accused will withdraw the appeal against his conviction.
Mohd Azmin had withdrawn the appeal of his conviction. Deputy Public Prosecutor (DPP) Tetralina Ahmad Fauzi appeared for the prosecution while counsel Hamid Ismail defended Mohd Azmin.
Meanwhile, Sani Puah, 68, was jailed 33 years for murdering Likap Maidar, 54, between 8am and 9.30am on Oct 29, 2016 at the Ladang Chong Su Min in Kg Sinar Jaya, Kinabatangan.
The Federal Court ordered Sani to serve the jail sentence from Oct 29, 2016.
Sani was sentenced to death by the High Court on Jan 24, 2020 and the sentence was maintained by the Court of Appeal on Jan 24, 2022.
DPP Nahra Dollah prosecuted while Sani was represented by counsel Zaleha Mohd Yusuf.
