Caretaker of nitespot fined for operating without permit
Marlina was charged under Section 3 of the Public Entertainment Ordinance 1958 and punishable under Section 11 of the same Ordinance which provides for a fine of up to RM50,000 or up to one year jail or both, on conviction.
Kota Kinabalu: A 28-year-old caretaker of an entertainment outlet was fined RM3,000 or three months jail on Monday for manning the premises without a valid licence.

Marlina Muji pleaded guilty before Magistrate Lovely Natasha Charles to committing the offence at Elips Café, Inanam Capital at 11.25pm on June 4.

Inspector Kelvan Elson Maik, prosecuting, told the court that the police raided the place following a tip-off and found the premises operating with music being played while a male customer was singing karaoke.

Investigations revealed that the premises was using a Class Two coffee house business license which was still valid.

However, the premises was found to have violated the licence conditions by carrying out karaoke activities using the said licence, the court heard.

Further investigations revealed that the premises had been conducting business since December 2021 and the owner of the premises had applied for a licence to conduct karaoke activities to City Hall but had yet to obtain the permission to do so.

Marlina was charged under Section 3 of the Public Entertainment Ordinance 1958 and punishable under Section 11 of the same Ordinance which provides for a fine of up to RM50,000 or up to one year jail or both, on conviction.

Duty counsel Lim Ming Zoong @ Lawrence, representing Marlina, requested a lower fine as Marlina is now self-employed. 

Meanwhile, six people were penalised for committing drug-related offences.

Five of them Jaidi Sorudin, Irwan Alex, Justin Lajimit, Eltah Ansip and Marwan Bindisan admitted to taking syabu at separate locations here and in Penampang in August.

Jaidi, Irwan and Marwan were jailed seven months each while Justin and Eltah were each fined RM2,300 or seven months jail.

Taking drugs under Section 15(1) of the Dangerous Drugs Act provides for a fine of up to RM5,000 or up to two years jail, on conviction.

The sixth person, Long, was jailed 10 months after he pleaded guilty to having 0.06gm of syabu on Aug 8 at Kg Hungab, Penampang.

He was charged under Section 12 (2) of the Dangerous Drugs Act 1952, which provides for a fine of up to RM100,000 or up to five years jail or both, on conviction.
