Kota Kinabalu: A 33-year-old man was fined RM10,000 in default four months’ jail for overstaying in the State.
Sessions Court Judge Amir Shah Amir Hassan meted out the sentence to Roni Majid, who pleaded guilty to the charge.
Roni was arrested on Oct 19 this year at 6pm by the roadside in Kg Delima, Manggatal after producing his IMM13 visit pass that had expired on Sept 29 this year.
He had overstayed in the State for 20 days.
The offence under Section 15(1)(c) of the Immigration Act 1959/63 carries a fine of at least RM10,000, or a jail term of up to five years, or both, on conviction.
After paying the fine or serving the jail sentence, Roni was ordered referred to the Immigration Department for deportation.
During mitigation, Roni who was not represented, asked for leniency saying that he has a wife and children to look after.
However, Deputy Public Prosecutor Dacia Jane Romanus urged the court to impose a deterrent sentence.
