Kota Kinabalu: A 28-year-old illegal immigrant was tentatively charged in the Magistrate’s Court here with trafficking 250.01gm of syabu.
Mal Jul was accused of committing the offence at 4pm on Nov 7 by the roadside of Kg Muhibbah, Manggatal, here.
However, no plea was taken from Mal, who appeared before Magistrate Stephanie Sherron Abbie, after the charge was read out to him.
The charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952 carries a punishment of either the death penalty or life in prison and whipping with a minimum of 15 strokes.
The prosecution applied for a new mention date while waiting for the chemist’s report and objected to bail for Mal as the charge has no provision for one.
The court fixed Jan 15 for mention pending the chemist’s report and ordered the accused to be further remanded.
In another case, a woman was fined RM1,000 or a month’s jail for having gambling paraphernalia.
Rafidah Abdul Rahman, 25, pleaded guilty to purchasing lottery without a licence at 2pm on Oct 6 in Donggongon.
The court heard from the prosecution that Rafidah was detained by police for involving in gambling activity and also seized the lottery tickets and RM73 cash, among other.
The offence under Section 9(1) of the Common Gaming House Act provides for a fine of up to RM5,000 or up to six months jail or both, on conviction.
Meanwhile, a storekeeper was charged in another Magistrate’s Court for burglary.
Jimar Aman, 37, pleaded not guilty before Magistrate Wan Farrah Farriza Wan Ghazali to breaking into a house belonging to Freddie Wong at Taman Malakun in Penampang at 10.30am on April 10.
The charge is framed under Section 457 of the Penal Code.
In applying for a mention date, the prosecution proposed bail at RM5,000 in two sureties.
Duty counsel Carmen Khoo, representing Jimar, applied for a lower bail sum.
The court fixed Dec 3 for pre-trial case management and released the accused on a bail of RM4,000 in two sureties.
In the same court, three men were sentenced for having syabu.
Harry Patrick, 42, Madilis Zain, 45, and Parando, 47, admitted separately to having syabu weighing 0.01gm, 0.16gm and 0.05gm respectively between May 12 and Aug 17 this year in Putatan, Inanam and the city centre.
Madilis was jailed 10 months while Harry and Parando were handed nine months jail each.
They were charged under Section 12 (2) of the Dangerous Drugs Act 1952, which provides for a fine of up to RM100,000 or up to five years jail or both, on conviction.
