Kota Kinabalu: A company was fined a total of RM6,000 on two counts of having for sale 20 types of unregistered products.
Teck Yen Sdn Bhd through its director pleaded guilty before Sessions Court Judge Amir Shah Amir Hassan.
On the first count, the company was fined RM2,000 for having for sale one unit of Shi Tu Che Yang.
The offence took place at 3.10pm on June 8 this year at Damai Plaza, Luyang, here.
The products were not registered with the Health Ministry.
The company committed the offence under Regulation 7 (1)(a) of the Control of Drugs and Cosmetics Regulations 1984 and punishable under Section 12(2) of the Drug Sales Act 1952 which carries a jail term of up to three years, or a fine of up to RM50,000 or both, on conviction.
On the second count, the company was fined another RM4,000 for having for sale 19 types of products which were not registered with the Health Ministry at the same place and time.
During mitigation, the representative asked for leniency.
However, Prosecuting Officer Amira Diyana Rosman from the Pharmacy Department urged the court to impose an appropriate sentence as the act could risk the public’s health as the products were not registered with the Health Ministry.
