Kota Kinabalu: Five men were jailed a week and fined RM5,000 or three months jail each for attempting to steal 155 sacks of packages/parcels.
Muqadzayyani Azis, 36, Grigorie George, 34, Muhammad Ariff, 35, Mohd Readwan Abu, 31, and Jonathan James, 36, pleaded guilty before Magistrate Stephanie Sherron Abbie to a charge of jointly committing the offence at 3.08pm on March 29, this year at the Borneo Sport Arena (BSA) here.
Two other accused, Musa Abdul, 37, and Muhammad Nizam, 24, claimed trial to the charge under Section 379 read with Section 511 of the Penal Code.
The court set Jan 11 for pre-trial case management of Musa’s and Nizam’s case and released them on a bail of RM2,000 in two sureties.
According to the facts of the case presented by the prosecution, the complainant, who was an operational assistant of a shipping company, received many complaints from courier service companies regarding the lack of parcels received by them.
The complainant then supervised the company’s lorry and followed the lorry that was supposed to transport the goods from the air cargo to a courier company in Inanam.
However, the lorry stopped at the BSA Kolombong parking lot.
The complainant found some company staff unloading several sacks of parcels and believed they were trying to steal some 150 sacks containing thousands of parcels belonging to a online shopping company.
Duty counsel Lim Ming Zoong, representing the five, requested for lower fine and that they had been remanded for several days adding that they did not make any financial benefit from the case and that the goods were eventually return to the original owner.
In another case, a man was sentenced to 10 months jail for abetting an individual during a theft offence.
Fabian Julian, whose case came up for pre-trial case management, pleaded guilty to abetting the individual in stealing a trolley containing several packets of rice belonging to Servay Express Sdn Bhd at Api-Api Centre at 8pm on Oct 23.
He was charged under Section 109 of the Penal Code.
