Kota Kinabalu: Two men were each sentenced to nine months in jail by the Magistrate’s Court here on Tuesday, for having syabu.
Muhamad Syamsul Ahmad, 39, and Muhammad Nor Ibrahim Abdullah, 32, pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali for having syabu weighing 0.02gm and 0.04gm, respectively, on different locations in Manggatal.
They were was charged under Section 12 (2) of the Dangerous Drugs Act 1952 which provides for a fine of up to RM100,000 or up to five years in jail or both, on conviction.
Deputy Public Prosecutor (DPP) Ling Guong Zhin told the court that during Ops Tapis, police seized a packet containing drug substance from Syamsul at 12:50pm.
The packet was sent to the Chemist’s Department, which confirmed it to be syabu, leading to Syamsul’s arrest.
Ling told the court that Ibrahim was arrested after he handed a plastic container with syabu to the police.
Counsel Carmen Khoo requested a lenient sentence for Syamsul, citing that he is divorced with two children and works as a lorry driver.
Counsel Lim Ming Zhoong @ Lawrence requested a lenient sentence for Ibrahim who is a carpenter and cannot afford to pay a fine.
Meanwhile, Ling applied a deterrent sentence for Syamsul and Ibrahim.
In the same court, a 24 year-old woman was fined RM100 or three days’ jail for fraudulently having RM3, 100 deposited into her bank account.
Nur Hidayah pleaded guilty to having money belonging to a complainant in her bank account.
She failed to give a satisfactory explanation on how she obtained the money at 10.50am on Sept 30 in Putatan.
She was charged under charged under Section 22A (1) of the Minor Offences Ordinance which provides for a fine of up to RM100 or up to three months’ jail or both, on conviction.
Ling said on Aug 25 the complainant came across an Instagram post advertising affordable notebooks.
Subsequently, the complainant initiated a transaction in three stages to a Bank Islam account belonging to Nur Hidayah.
Despite completing the payment, the complainant did not receive the notebook and felt deceived.
The complainant lodged a police report, leading to the arrest of Nur Hidayah.
Lim presenting Nur Hidayah, requested for a lenient fine, but Ling applied for an adequate sentence.
