Kota Kinabalu: Two police personnel were charged in the Magistrate’s Court here with several counts of causing the disappearance of evidence of alleged Customs offences committed.
Lance Corporal Norsalihah Seli, 30, and Constable Adrie Ezuandie Mohd Khir, 36, who appeared before Magistrate Lovely Natasha Charles, pleaded not guilty to the charges.
The charges stated that the accused knew that an offence under Section 135(1)(d) of the Customs Act 1967 was committed and caused evidence of the commission of the offence to disappear, with the knowledge that their action would cause the offenders of the case to be prevented from being punished.
Norsalihah is facing four counts of committing the offence on six boxes of cigarettes in June 2021 at a house in Kg Suang Parai; 14 boxes of cigarettes in July 2021 at a rented house in Kg Dungang, Tuaran; 190 cartons of beer in December 2021 at the Centralised Exhibits Store here and 190 cartons of beer on Feb 4, 2022 at the Centralised Exhibits Store.
Adrie is also facing four counts of the offence on 15 cartons of Tiger beer in January 2021 at the Centralised Exhibits Store; a box containing 50 pax of Era cigarettes at the end of April 2021 at the same place; 15 cartons of Anchor alcoholic drinks at the end of October 2021 at the same place; and 50 cartons of Carlsberg and 10 cartons of Cool beer at the end of January 2022, also at the same place.
Norsalihah and Adrie were also jointly accused on two counts of the offence on 290 cartons of Carlsberg in December 2021 at Kg Dugang and 285 cartons of Carlsberg in the middle of January 2022 at the same village.
Each charge is framed under Section 201 of the Penal Code.
Deputy Public Prosecutor (DPP) Ling Guong Zhin in applying for a pre-trial case management (PTCM) proposed bail at RM5,000 in two sureties and for the accused to report to the police station once a month.
DPP Ling also informed the court that the total loss in the cases was RM443,180.
Duty counsel Lim Ming Zoong @ Lawrence requested a lower bail bond as both accused are still in service.
Lovely fixed Feb 5, 7 and 14 for PTCM and released the accused on a bail of RM1,500 in two sureties on each case and ordered them to report to the investigating officer once a month.
