Kota Kinabalu: A cinema worker was jailed 12 months by the Magistrate Court, Tuesday, for recording a woman in a cinema toilet with a smartphone.
Muhammad Ikhwan Johari, 20, pleaded guilty before Magistrate Stephanie Sherron Abbie, for insulting the modesty of the 25-year-old complainant.
Ikhwan committed the offence at 5.30pm on Nov 26, last year, at the women’s toilet in Cineplex Cinema, City Mall, here.
He was charged under Section 509 of the Penal Code which carries a jail term of up to five years or fine, or both, on conviction.
Prosecuting Officer Inspector Suzie SK told the court that on the said day, the complainant noticed a mobile phone pointed at her from the top of the toilet door.
The complainant promptly filed a complaint with the cinema management and as a result of the CCTV inspection, it was revealed that Ikhwan, an employee at the
cinema as confirmed by the supervisor, was recording the complainant.
The police confiscated the mobile phone as evidence for further action.
Duty Counsel Carmen Khoo, representing Ikhwan, requested a lenient fine as he was currently unemployed and had to take care of his parents.
Suzie applied for a deterrent sentence.
The court ordered Ikhwan to serve the sentence from the date of his arrest.
