Man charged with assaulting, threatening wife, daughter
Section 323 carries a jail term of up to one year or a fine of up to RM2,000, or both, on conviction while Section 326A states that whoever causes hurt to his spouse or former spouse, child, disabled adult, or other family members and commits an offence under Section 323, 324, 325, 326, 334 or 335 shall be punished with imprisonment for a term of twice as long as the maximum term for which he would be liable to, on conviction.
Kota Kinabalu: A 40-year-old man was charged in the Magistrate’s Court with three counts of assaulting and threatening his wife and daughter.

Ardy Ngadeni pleaded guilty before Magistrate Lovely Natasha Charles to two counts of voluntarily causing hurt to his wife and daughter at 9.10pm on Jan 22 year at a house in Kampung Lapasan, Telipok.

Ardy was charged under Section 323 of the Penal Code read together with Section 326A of the same Code.

Ardy pleaded not guilty to the third count of threatening to kill his wife at 9.10am on Jan 22 at the said location.

The charge under Section 506 of the Penal Code carries a jail term of up to seven years or fine or both, on conviction.

However, Ardy’s wife, who was present in the court, informed the magistrate that she wanted to withdraw the police report for the third count. The court set March 3 for instruction from the Deputy Public Persecution’s office.

Prosecuting Officer, Inspector Kelvan Elson Maik, proposed bail of RM 4,000.

The court released Ardy on bail of RM2,000 with two sureties and ordered him not to tamper with his wife and daughter.
