Magistrate sentences man for stolen motorbike
Arfin was charged under Section 411 of the Penal Code which carries a jail term of between six months and five years and liability of a fine, on conviction.
Kota Kinabalu: A 34-year-old man was fined RM2,000 or six months jail by the Magistrate’s Court, Wednesday, for having a stolen motorcycle, three years ago.

Arfin Jani pleaded guilty before Magistrate Stephanie Sherron Abbie, to having a stolen motorcycle belonging to one Suriady Edy at 7.30pm on Jan 27, 2021 at the Taman Putera Jaya’s basement, Telipok.

Arfin was charged under Section 411 of the Penal Code which carries a jail term of between six months and five years and liability of a fine, on conviction.

The court heard from the prosecution that the motorcycle was reported stolen from the complainant’s basement and was last seen at the same date on 6pm.

Arfin was arrested by police at the side road in Penampang, where the stolen motorcycle was found in his possession.

Unrepresented, Arfin applied for a lenient sentence.

In another case, a 36-year-old unemployed was fined RM1000 or month’s jail for having illegal paraphernalia.

Jubick Sadikal pleaded guilty to purchasing illegal lottery tickets at 3.40pm on Jan 28, this year at Petagas town, Taman Jumbo, Putatan.

Jubick was charged under Section 9(1) of the Common Gaming House Act 1953 which provides for a fine of up to RM5,000, up to six months in jail, or both, on conviction. 

The prosecution told the court that police arrested Jubick for conducting public lottery sales activities without a license. 

The police also seized one public lottery print receipt and RM24 cash.

Duty Counsel Lim Ming Zhoong @ Lawrence, representing Jubick, requested a lenient fine.

Stephanie ordered the seized money to be forfeited as government revenue.
