TAWAU: A 74-year-old Australian man was ordered to enter his defence by the Sessions Court, Tuesday, on a charge of committing physical sexual harassment against his friend’s niece.
Sessions Court Judge Rosli Ahmad made the order to Jack Kwong after ruling that the prosecution had established a prima facie case.
The court set May 3 for Jack’s defence.
Jack is accused of committing the offence against the 13-year-old girl by kissing and touching some of her body parts.
The offence allegedly took place at 7.20am and 8am on May 20, 2023 at a house in Jalan Mawar.
The offence, under Section 14(a) of the Sexual Offences Against Children Act 2017, provides for a jail term of up to 20 years, and whipping, on conviction.
Deputy Public Prosecutors Mohd Suhaimi Suriana and Hurman Hussain prosecuted, while Jack was represented by Counsel Mark Rosaidey.
