Kota Kinabalu: A 37-year-old jobless was charged with committing Criminal Breach of Trust (CBT) involving a sum of RM12,855.35.
Ajinin Masuta pleaded not guilty before Sessions Court Judge Elsie Primus, Thursday.
He is accused of breaching the trust given to him as a lorry driver and cooking gas cylinder seller by Syarikat Len Niap in which the company had entrusted him with the sales collection but had used it for his own.
Ajinin allegedly committed the offence between April 28, 2023 and May 27, 2023 at the company’s premises in Kudat.
The offence under Section 408 of the Penal Code carries a jail term of between one and 14 years, and liable to fine or whipping, on conviction.
The court set April 25 for case management and released Ajinin on a bail of RM15,000 with RM7,000 deposited in two local sureties.
He was also ordered to report to the Kudat police station once a month as well as his passport, if any, to be kept by the court until the disposal of his case.
The court also reminded Ajinin not to tamper with the prosecution witnesses.
Deputy Public Prosecutor Siti Hajar Mazlan appeared for the prosecution while duty counsel Michelle Usman defended Ajinin.
