Trafficking 285gm cannabis: Man told to enter defence
He was charged under Section 7(2) of the same Act which provides for a fine of up to RM5,000 or up to six months jail or both on conviction.
Kota Kinabalu: A 43-year-old man, who was charged with trafficking 285.18gm of cannabis, was ordered to enter his defence.

High Court Judge Datuk Ismail Brahim made the order on Vinod Kumar Gopal.

Ismail in delivering his ruling held that the court found that the prosecution had proved a prima facie case at the end of the Prosecution stage. 

There was evidence of actual or direct possession of the drugs, he held.

The court fixed July 1 and 2 for Vinod’s defence.

Counsel Datuk Ram Singh, representing Vinod informed the court that they have two defence witnesses.

Vinod allegedly committed the offence at 12.15am on Feb 27, 2020 by the roadside in front of the Nur Arisyah Enterprise tyre shop, Kg Kuala Benoni, Mile 29, Jalan Andus in Papar.

He had on May 27, 2021 claimed trial to the charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952.

The prosecution had called six witnesses in the trial.

Deputy Public Prosecutor (DPP) Rozana Abdul Hadi prosecuted.

Vinod was ordered to be remanded further as the charge against him has no provision for bail.

In another case, a man was fined RM2,000 or two months in jail for engaging in an illegal online gambling activity in public.

Ekhmal Shazrie pleaded guilty before Magistrate Lovely Natasha Charles to committing the offence on Nov 10, 2023, at 8.30pm at a shophouse of the University Apartment, Jalan Sulaman.

He was charged under Section 7(2) of the same Act which provides for a fine of up to RM5,000 or up to six months jail or both on conviction.

Meanwhile, two men were jailed nine months each for having syabu.

Md Shafendy Julhani and Md Salleh Hassan pleaded guilty to having syabu weighing 0.14gm and 0.07gm, respectively, on Feb 19, in Kg Cenderakasih 2, Likas and on Jan 31 at Kg Sembulan.

They were each charged under Section 12 (2) of the Dangerous Drug Act 1952, which provides for a fine of up to RM100,000 or up to five years jail or both on conviction.
