DBKK urges developers to comply with conditions
Mayor said several developers disobeyed the warnings and conditions set by DBKK, repeatedly triggering public complaints and polluting the peace of the affected residents’ environment.
Kota Kinabalu: Kota Kinabalu City Hall (DBKK) calls on all developers to act seriously in complying with the conditions of development approval, as provided under the By-laws (Building) 1951 and the Local Government Ordinance 1961.

Based on DBKK’s latest monitoring, Mayor Dato Sri Dr Sabin Samitah said several developers disobeyed the warnings and conditions set by DBKK, repeatedly triggering public complaints and polluting the peace of the affected residents’ environment.

“Acting on repeated complaints regarding a developer company that did concreting work beyond the working hours in Luyang, DBKK had taken inspection action and issued a compound.

“This was in addition to issuing a warning letter to the Project Consultant and Developer for non-compliance with the working hours allowed,” he said in a statement.

Earlier, a total of 16 compounds were issued against the developer for violating the conditions of the approval of the development plan set, which is executing work beyond the permitted time period causing a disturbance to the residents of nearby housing. 

At the same time, the DBKK also took note of the developer’s explanation regarding the constraints faced, namely the large volume of concrete work and disruption of concrete supply.

“Coordination efforts between DBKK with developers, consultants and complainants have also been held before, until they reached an agreement on the allowed working hours from Monday to Saturday (except Sundays and public holidays), from 7.30am to 6pm only.

“Monitoring actions will continue from time to time so as not to affect any project completion process.

“However, if non-compliance with these conditions continues, a Court Order will be imposed to stop the construction works, for the offense of non-compliance with the conditions of plan approval as provided under the By-laws (Building) 1951 and the Local Government Ordinance 1961 (Disturbing),” it said.
