Illegal jailed for using another person’s MyKad

KINABATANGAN: A 44-year-old illegal immigrant who had used a MyKad of another person for 13 years was jailed 12 months.

Magistrate Mohammad Azeem Mohd Ridzo handed down the sentence to Amir Abdullah, who pleaded guilty to the charge against him on Tuesday.

Amir was found using a fake document when he applied for it.

Amir had used the late birth certificate which was not his when applying for the document under serial number 800911-12-6399 under the name Abdul Kadir Nurdin at 11.52am on May 5, 2011.

The offence under Section 25 (1) (b) of the National Registration Regulations 1990, which provides for a maximum imprisonment of three years or a fine not exceeding RM20,000, or both, upon conviction.

During mitigation, Amir asked for leniency saying that he has four children to look after.

However, Prosecuting Officer Mohamad Faizal Tahir from the National Registration Department (NRD) urged the court to impose a heavy sentence submitting that using fake document was a serious offence and such action could give impact to the integrity of the law system and public trust.

The court heard that on June 12, 2019, the real owner of the birth certificate under the name Abdul Kadir Nurdin had made a complaint at the Sabah State NRD Investigation and Enforcement Division counter regarding his birth register which was issued to another person (the accused).

The testimony of the witnesses, who are the siblings of the real owner, also confirmed that the real owner of the birth certificate was never issued with an identity card because the identity card was issued to the accused.

The thumb print of Amir on the identify card application also confirmed that the MyKad was issued to him, while the DNA report issued by the Department of Chemistry Malaysia, Sabah confirmed the relationship between the real owner of the birth certificate in the name of Abdul Kadir Nurdin and those who gave testimony were siblings.

Amir was then arrested on June 23 this year at about noon at a fast food restaurant in Bandar Kim Fung, Batu 4, Sandakan.

After serving the jail sentence, Amir was ordered referred to the Immigration Department.
