Guard jailed over copper earthing plate
Safari was jointly charged with another accused, Md Affendy Ibrahim, who was not present in the court Friday, to the crime under Section 431A of the Penal Code read together with Section 109 of the same Code.
Kota Kinabalu: A security guard was on Friday jailed seven months for abetting his accomplices to tamper with the copper earthing plate at a condominium where he works.

Safari Sabile, 31, pleaded guilty before Magistrate Lovely Natasha Charles to abetting two accomplices still at large to commit the offence on April 9 between 3.17am and 4.45am on the 26th floor of Elemen Utara KK Condominium, Manggatal.

Safari was jointly charged with another accused, Md Affendy Ibrahim, who was not present in the court Friday, to the crime under Section 431A of the Penal Code read together with Section 109 of the same Code.

Earlier, the court was informed by the prosecution that police investigations revealed that the complainant discovered a copper earthing plate measuring 244 metres stolen with an estimated loss of RM48,000.

CCTV footage recorded Safari abetting the two accomplices to cut the copper and did not prevent them from leaving nor report the incident to his superiors.

The investigations also revealed that Safari had allowed outsiders access, using a key provided to him as a security guard.

Duty counsel Carmen Khoo, representing Safari, requested a lenient sentence as he was remorseful.

Deputy Public Prosecutor (DPP) Muhammad Al-Hakim Abdul Razak applied for a deterrent sentence.

Lovely ordered Safari to serve the sentence from the date of his arrest.

The court also granted the prosecution’s application to issue a warrant of arrest against Affendy and set Aug 30 for review of the arrest warrant.

In another case, a clerk claimed trial to misappropriating RM31,816 cash belonging to the company.

Azurawati Abdul Suili, 38, who appeared before Magistrate Wan Farrah Farriza Wan Ghazali, allegedly misused the money belonging to Global Transmission Service Centre  between July 10 and July 17.

Charged under Section 403 of the Penal Code, the accused was offered bail at RM3,500 in two sureties pending pre-trial case management (PTCM) on Aug 29.

Meanwhile, two men pleaded not guilty separately to the charge of assault.

Unemployed Rames Tinggalung @ James, 50, was accused of voluntarily causing hurt to Helxmond Mansawari, 18, with a glass bottle on July 9 at noon,  Kg Minintod, Penampang.

The court set Aug 29 for PTCM and released the accused on a bail of RM2,500 in two sureties.

The other man, night market vendor Mohammad Rizal Razlan, 20 was accused of voluntarily causing hurt to Mohamad Akmal Mohd Amir, 28, on July 9, at 11.15pm, outside the Borneo Sports Area BSA Futsal court in Kolombong.

Rizal was offered bail at RM1,500 in two sureties while waiting for PTCM also on Aug 29.

Rames and Rizal were charged under Section 324 of the Penal Code and Section 323 of the same Code, respectively.
