Kota Kinabalu: A 26-year-old man was sentenced to life and 12 strokes of the cane by the High Court here for trafficking 200.08gm of cannabis, five years ago.
Dick Lai Cheng Kaai, a leaflet distributor, was found guilty and convicted of the charge by High Court Judicial Commissioner Datuk Faridz Gohim Abdullah on Friday.
Lai committed the offence on July 21, 2019, at 11.45am at the edge of the Comi Comi Hamburger Sandwich Shop, Block D of Bundusan Commercial Centre 2, Penampang.
He had on Sept 22, 2020 pleaded not guilty to the charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952 which carries the death sentence or imprisonment for life and whipping not less than 15 strokes if not sentenced to death, on conviction.
Lai, who was on March 25, this year ordered to enter his defence, gave unsworn evidence in his defence.
Six witnesses were called to testify during the prosecution’s stage.
Deputy Public Prosecutor Afiq Agoes prosecuted while Lai was represented by counsel Azhier Farhan Arisin.
In another case, an entertainment outlet owner was fined RM3,500 or two months jail by the Magistrate’s Court here for operating his business beyond the permitted time.
Chen Shin Yow, 30, pleaded guilty before Magistrate Lovely Natasha Charles to committing the offence at the M Club, JQ Central, Coastal Highway, Off Jalan Tun Fuad Stephens on June 11 at 2.47am.
The charge stated that Chen had operated the premises beyond the stipulated time of 2am as stated in the licence issued to the premises under Section 5(1) of the Public Entertainment Ordinance 1958.
Earlier, the prosecution informed the court that a police team raided the place and found it still operating with loud music with customers inside.
The offence under Section 3 of the Public Entertainment Ordinance 1958 and punishable under Section 11 of the same Ordinance which provides for a fine of up to RM5,000 or up to one year or both, on conviction.
