Kota Kinabalu: A 36-year-old lorry driver was charged in a Magistrate’s Court here Thursday with assaulting a woman here last week.
Jiko Antuloi pleaded not guilty before Magistrate Wan Farrah Farriza Wan Ghazali to voluntarily causing hurt to Fedilia Marcus, 46, by hitting her on the back of her head, mouth, face, hands and legs on Sept 12 at 6.15am, Likas Hospital.
The charge under Section 323 of the Penal Code carries a jail term of up to a year and liability of a fine of up to RM2,000 or both, on conviction.
The prosecution in applying for case management date proposed bail at RM2,000 in two sureties with an additional condition for the accused not to tamper with the complainant.
Duty counsel Lim Ming Zoong @ Lawrence, representing Jiko, requested a lower bail amount because he is married with four children and works as a lorry driver earning RM1,500 a month.
Wan Farrah fixed Oct 25 for pre-trial case management (PTCM) and released Jiko on a bail of RM2,500 in two sureties and ordered him not to tamper with any of the prosecution’s witnesses.
In another case, a 60-year-old man claimed trial to shoplifting.
Unemployed Darmansah Unsun was accused of stealing two bottles of hair gel creams worth RM16.50 at the Bataras Superstore in Inanam Plaza on Sept 11 at 12.50pm.
Darmansah had earlier pleaded guilty to the charge under Section 380 of the Penal Code but changed his plea to not guilty after hearing that he would face a sentence of up to 10 years’ imprisonment, a fine, or both, on conviction.
The prosecution proposed bail at RM5,000 in two sureties.
Duty counsel Lim applied for a lower bail amount as he is 60 years old, currently unemployed and married with five children.
The court set Nov 18 for PTCM and offered the accused bail at RM1,000 in two sureties.
