Kota Kinabalu: A 51-year-old jobless man who hit his father with an iron rod which resulted in a fractured left hand and injuries on the right leg, was jailed 30 months and fined RM5,000 in default six months’ jail.
Clarence Yen Tsin Hsung pleaded guilty before Sessions Court Judge Marlina Ibrahim, to the charge against him, Monday.
Yen had hit his 76-year-old father with the iron rod at 10am on Aug 10 at the kitchen of house in Taman Kinamas in Beaufort.
The offence under Section 326 of the Penal Code which carries a jail term of up to 20 years, and whipping or fine.
It was also read together with Section 326A of the Penal Code which provides for double the penalty punishment.
During mitigation, Yen who was not represented, informed the court that he wanted to be released.
Throughout the proceedings, the court keep asking Yen whether he understood the charge against him and the consequences of his plea and Yen said ‘yes’.
Deputy Public Prosecutor Afiqah Alya urged the court to impose a heavy sentence which would serve as a deterrent not only to Yen but the public at large.
The court ordered Yen to serve the jail sentence from the date of his arrest.
