Kota Kinabalu: A 34-year-old illegal immigrant was jailed eight years and ordered to get three strokes of the cane for raping an underaged girl.
Sessions Court Judge Amir Shah Amir Hassan handed down the sentence to Ibrahim who pleaded guilty to the charge against him.
Ibrahim had raped the 15-year-old girl at 9am on Sept 11 inside a toilet of a restaurant in Kimanis, Papar.
The offence under Section 376(1) of the Penal Code carries a jail term of up to 20 years and whipping, on conviction.
During mitigation, Ibrahim asked for leniency. However, Deputy Public Prosecutor DK Afiqah Alya urged the court to impose a deterrent sentence as to give a lesson not only to Ibrahim but other would be offender.
She submitted that it was a serious offence and a heavy sentence must be imposed. The court ordered Ibrahim to be referred to the Immigration Department after releasing from prison for deportation.
The court heard that Ibrahim and the victim had met on the said day and later had sex inside the toilet.
The report from a doctor who conducted the examination on the girl confirmed that there was an old tear on her hymen.
Further investigation revealed that Ibrahim had raped the victim inside the toilet.
