Kota Kinabalu: A 36-year-old man who raped his daughter since she was eight-year-old, was jailed 16 years and ordered to be given 10 strokes of the cane.
The labourer pleaded guilty before Session Court Judge Amir Shah Amir Hassan, to the charge against him.
The man had raped the 12-year-old girl in early January this year at 1am at a house in a village in Papar.
He committed the offence under Section 376(3) of the Penal Code which provides imprisonment of between 10 and 30 years, and whipping at least 10 strokes, on conviction.
During mitigation, the man who was not represented, asked for a lenient sentence.
But, Deputy Public Prosecutor Nurul Shafeerah Mad Iskim urged for a deterrent sentence due to heinous and unacceptable act towards his daughter.
“The accused is the biological father of the victim, whose duty to protect the daughter, especially when the mother had separated from them when the daughter was five years old.
“However, the accused had betrayed the trust of his daughter by raping the poor daughter,” she said, highlighting that the victim was raped more than 10 times.
The facts of the case stated that the victim was raped by the accused since she was eight years old in 2020 and the last incident was early this year.
The incident came to light after the victim told her friend and her class teacher.
Further investigation revealed that the victim was threatened by the father not to tell anyone about the rape incident.
The father had divorced with his wife and their daughter (the victim) was living with him.
Following a police report by the victim’s grandfather on July 16, the man was arrested.
