Kota Kinabalu: A lorry driver was on Tuesday fined RM1,000 or one month’s jail by the Magistrate’s Court here for fighting in public last year.
Mahiruddin Bahdin, 29, pleaded guilty before Magistrate Marilyn Kelvin to committing affray that disturbed public order on July 3, 2023, at 3.30pm, at a grocery shop, Bundusan Square, Penampang.
Mahirudddin’s case came up for pre-trial case management (PTCM) Tuesday but he informed the court that he wished to change his plea to guilty to the charge.
The offence under Section 160 of the Penal Code carries a jail term of up to six months or fine, or both, on conviction.
Duty counsel Lim Ming Zoong, representing Mahiruddin, requested a lower fine, noting that he is married with four children and his wife is currently pregnant.
Inspector Alia Nuurlysa Adnan applied a deterrent sentence.
The court ordered Mahiruddin’s bail to be refunded to him.
In another case, an unemployed man was jailed six months for having housebreaking tools.
Napoleus Josili admitted to having a crowbar and a machete on June 14, this year, at 5.30pm, at the roadside of Likas Bay, here.
He committed the offence with another man, named Sebastian.
Napoleus’ case was also scheduled for mention on Tuesday but he informed the court that he wanted to plead guilty to the charge.
The charge under Section 8(e) of the Minor Offences Ordinance provides for a jail term of up to six months, on conviction.
Napoleus, unrepresented, requested for the sentence to run from the date of his arrest.
The prosecution urged for a deterrent sentence.
The court ordered Napoleus to serve the sentence from the date of his arrest.
Meanwhile, a security guard was charged with committing mischief by damaging property in a premises.
Ibrahim Maulod, 34, pleaded not guilty to committing the offence on Sept 19, at 11.35pm, at Beverly Hills, Bundusan, Penampang.
He was charged under Section 426 of the Penal Code which carries a jail term of up to five years, fine, or both, if convicted.
The prosecution applied for a ptcm date and proposed bail at RM7,000 with two sureties.
Counsel Lim Ming Zoong, representing Ibrahim, applied for a lower bail amount, citing that he is an IMM13 holder, married with two children, and the sole breadwinner for his family.
The court fixed Oct 17 for PTCM and offered the accused a bail of RM2,000 in two sureties.
