Kota Kinabalu: Two individuals were fined a total of RM10,000 by the Magistrate’s Courts here Tuesday for operating entertainment premises without a licence.
Kok Jun Haw, 50, was ordered to pay a fine of RM6,000 or one month jail after he pleaded guilty before Magistrate Marilyn Kelvin to committing the offence at the On The Way Café, Plaza Kingfisher, Inanam, on Sept 23, this year, at 11.30pm.
Jesyntiya Pitor, 29, was fined RM4,000 or two months jail after she admitted before Magistrate Wan Farrah Farriza Wan Ghazali to committing the offence at D’Boss Café, Sulaman Central, Jalan Sepanggar Baru, Kuala Manggatal, on Oct 2, this year, at 11.13pm.
The two were found to be manning the business without a valid licence issued under Section 6 (1) of the Public Entertainment Ordinance (PEO) 1958.
They were each charged under Section 4 of the PEO 1958 and punishable under Section 11 of the same Ordinance which provides for a fine of up to RM50,000 or up to one year jail or both on conviction.
In Kok’s case, the court heard from the prosecution that the police raided the place on Ops Noda and found the premises was in operation with music being played and customers drinking alcoholic beverages.
Investigations revealed that the premises was trading using a Class Two coffee house business licence and breached the condition of the stipulated licence by operating entertainment activity without a valid licence.
In Jesyntiya’s case, the prosecution informed the court that the police raid found the premises had dim lighting, and loud music was playing while customers consumed alcoholic beverages.
An inspection revealed that the premises did not have a karaoke or alcohol trading licence and that a check with City Hall also indicated that the premises only held a Class Two coffee shop business licence, said the prosecution.
In another case, a 22-year-old man was sentenced to 14 months jail for vehicle thefts. Albeto Saleh, changed his plea to guilty before Magistrate Marilyn to stealing a BMW X3 belonging to one Ang Li Jin on June 3, between 5am and 7.15am, at SH Euro Auto Parts workshop, Wisma KKM, Jalan Tuaran.
He had committed an offence under Section 379A of the Penal Code which carries a jail term of between one year and seven years or fine or both, on conviction.
