Kota Kinabalu: A 37-year-old man was jailed seven years and ordered to get a stroke of the cane for robbing a man.
Abdul Saad Sulaiman pleaded guilty before Sessions Court Judge Noor Hafizah Mohd Salim.
He robbed the 28-year-old man of his handphone by using a rower at 5.30pm on Oct 24 by the Likas riverside in Jalan Kingfisher, here.
Abdul had committed the offence together with another accused Jeffrey Jais who admitted and was sentenced accordingly.
The offence under Section 397 of the Penal Code carries a jail term of up to 20 years, and whipping, on conviction.
During mitigation, Abdul asked for leniency.
However, Deputy Public Prosecutor Eugenie Meredith Gilbert asked for a heavy sentence on the grounds that it was a serious offence.
The court heard that the incident happened while the victim and his friends were fishing at the area when two unknown men approached them, one of them asked for a cigarette.
Suddenly, one of the men, later identified as Jeffry, took out the machete and the other man, identified as Abdul, took out a rower.
Abdul and Jeffrey then threatened the victim and his friends with the weapons.
The victim’s friends managed to escape but the duo robbed the victim of his handphone.
The victim then lodged a police report and the duo was arrested thereafter.
