Duo jailed for cutting electric cable
They were jointly charged under Section 431A of the Penal Code, which carries a jail term of up to two years or a fine or both, on conviction.
Kota Kinabalu: Two men were jailed six months each by the Magistrate’s Court here Friday for committing mischief by cutting electric cable.

Unemployed Ismail Brahim, 31, and factory worker Md Aris Sham, 25, pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to cutting a 32-foot long cable on Dec 27, 2024, at 9.55am, at the UiTM Kota Kinabalu, near here.

Deputy Public Prosecutor Yuvan Bharathan, presenting the facts of the case, informed the court that on the said day, Ismail and Aris, who were unknown to the complainant, were spotted in the area digging soil to retrieve the cable.

The complainant then contacted the police for assistance. 

Acting on the information, a police team from Manggatal Police Station arrested two men, later identified as Ismail and Aris, for their involvement in the case.

The estimated loss was approximately RM1,000, said the prosecution.

Counsel Carmen Khoo, representing both men, requested lenient sentence.

The court ordered Ismail and Aris to serve the imprisonment sentence from the date of their arrest.

Meanwhile, a 23-year-old undocumented man was jailed eight months and fined RM1,000 or one month in jail for keeping a stolen motorcycle.

Azmi Akram pleaded guilty before Magistrate Dzul Elmy Yunus to having the stolen Yamaha motorcycle belonging to Saini Selphi on Dec 7, last year, at 1.50am, at Putrajaya Telipok residency area.

The charge under Section 411 of the Penal Code carries a jail term of between six months and five years and a fine, on conviction.

The court heard from the prosecution that the machine was reported missing from Kg Minintod, Jalan Bantayan, Inanam on Oct 6, 2024, prompting its owner to lodge a police report. 

Acting on information, the police arrested Azmi at the Putrajaya Telipok residential area, and a Yamaha motorcycle with a fake number plate was seized from him.

A check through IPRS Mysikap JPJ on the motorcycle’s chassis and engine numbers revealed that it was the motorcycle that had been reported missing.

Azmi, who was not represented, requested a lenient sentence from the date of his arrest. 

Inspector Kelvan Elson Maik applied for an appropriate sentence and informed the court that Azmi was undocumented, had no previous conviction record, and requested that he be referred to the Immigration Department.

Dzul ordered Azmi to serve the imprisonment sentence from the date of his arrest and to be referred to the Immigration Department thereafter.
