Kota Kinabalu: An undocumented man was sentenced to six months jail on Wednesday for trespassing into a house here.
Jobless Kadz Muyung, 24, pleaded guilty before Magistrate Marilyn Kelvin to trespassing into the house area occupied by one Dg Nur Syaffinah at Kg Likas, here on Oct 29, this year, at 3.21pm.
The facts of the case presented by the prosecution stated that Kadz, who was unknown to the complainant, was caught red-handed by the complainant while he still in the house compound.
Kadz could not take anything from the house and was handed to police who came to the house after being contacted by the complainant.
The prosecution stated that Kadz confessed to having sneaked into the house compound by climbing the fence.
He was charged under Section 447 of the Penal Code, which provides for a jail term of up to six months or a fine of up to RM3,000 or both on conviction.
The court ordered Kadz to serve the sentence from the date of his arrest and be referred to the Immigration Department thereafter.
In another case, a fisherman was fined RM1,800 or five months jail for theft.
Masrie Damang, 40, pleaded guilty to stealing a piece of luggage belonging to one Nur Ayreen Maisarah at the lobby of a hotel in Asia City here, on Nov 10, this year, at 4 35pm.
Masrie changed his plea to guilty to the charge under Section 380 of the Penal Code which carries a jail term of up to 10 years and liability of a fine on conviction.
He had on Nov 18, 2024 claimed trial to the charge and was released on a court bail. The court heard from the prosecution that Masrie’s stealing was recorded in the hotel’s CCTV.
The hotel’s staff managed to detain Masrie with help from the public near a shop in Bandaran Berjaya and handed him to police.
The prosecution informed the court that the total loss was RM2,000 and the bag was in good condition.
Unrepresented, Masrie requested a lenient sentence.
Prosecuting officer Inspector Yusdi Basri applied an appropriate sentence.
The court ordered the exhibit to be returned to its owner.
