Kota Kinabalu: A former director of the Sabah National Anti-Drugs Agency (AADK) and AADK Tawau Chief were charged with using fake documents to obtain payments for various AADK programmes in Tawau, involving a sum of RM46,641.92.
Former Director Bakri Bibi, 52, and Abd Gani @Ghani Keruput, 46, pleaded not guilty Wednesday to all the charges against them.
On the first to 27 counts, Bakri and Abd Gani are accused of using fake vouchers for a company which supplied food and drinks, rental tents, building materials and equipment for various AADK programmes in Tawau in October and November 2018.
The offence, under Section 471/468 of the Penal Code and read together with Section 34 of Penal Code, carries a jail term of up to seven years and fine, on conviction.
Bakri is also facing 14 charges of abetting with Abd Gani in using fake documents, which were paper works for various AADK programmes in Tawau, to obtain payments between November 2018 and May 2019.
He was charged under Section 471/465 of the Penal Code and read together with 109 of the same Code, which carries a jail term of up to two years or fine, or both, on conviction.
Bakri was also charged with using his position as a director during the alleged crime, to get bribe by approving the contract for cleaning and sanitation services for the AADK Sabah State Office, AADK Kota Kinabalu, Sandakan, Tawau, Labuan and the Remand Centre (PTR) to a company on Nov 20, 2017 at the Sabah AADK office in Wawasan Plaza, here.
The offence under Section 23(1)(a) of the Malaysian Anti-Corruption Commission (MACC) Act 2009 is punishable under Section 24(1) of the same Act, which carries a jail term of up to 20 years and a fine of not less than five times the amount of bribe, or up to RM10,000, whichever is higher, on conviction.
The court set April 14 this year for pre-trial case management and released the duo on a bail of RM30,000, with RM4,000 deposited in a local surety each, as well as to report to the MACC office once in two months.
Their passports, if any, are also to be impounded by the court pending the disposal of their cases.
The duo were also reminded to not tamper with the prosecution’s witnesses.
MACC Prosecuting Officer Dzulkarnain Rousan Hasbi appeared for the prosecution, while Abd Gani was represented by counsel Lim Chun Yuan and Bakri was not represented.
