Report lodged on nod granted to a bankrupt
The police should investigate whether the plaintiff’s action was made before or after 29.2.2024 and, hence, whether any wrongdoing was committed and for appropriate action to be taken against any wrongdoers.
Kota Kinabalu: A report has been lodged urging police to investigate how an undischarged bankrupt was able to obtain special sanction by the Insolvency Department so that he can sue two parties for alleged defamation. 

In particular, how this purported sanction was granted so much so that a certain official in the department was even able to know the suit number being filed in advance and to make reference to this suit number in the sanction that was granted by it.

The sanction states that the plaintiff applied for it on 23.2.2024 but the complainant said there is reason to suspect that the sanction was applied for and/or given only after the issuance of the court order on 29.2.2024.

In the report, the complainant said knowing or being aware that a sanction is required to comply with section 38 (i) (a) of the Insolvency Act 1967,  this sanction that was purportedly granted was deliberately backdated to 27. 2. 2024.
