Kota Kinabalu: Six soldiers from the peninsula, jointly charged with killing their 26-year-old colleague five years ago, will know on Feb 17 this year whether they will have to answer the charge against them or otherwise.
High Court Judge Datuk Ismail Brahim set the date for the six when the prosecution closed its case after calling 20 witnesses.
The six are Mohamad Zaki Gusam, 31, Mohd Farhan Mohd Fudzi, 33, Mohamad Faeszudin Mohamad Jaes, 34, Mohammad Hasrul Faiz Mustaffa, 35, Mohd Borhan Zakaria, 36, and Muhammad Nazri Mohd Kahar, 29.
The charge stated that they allegedly murdered Muhammad Faiz Harun, 26, also from the peninsula, at the Mapan-Mapan Post, Kg Mapan-Mapan in Pitas, between 1am and 2.30am on March 22, 2020.
The offence under Section 302 of the Penal Code which carries a death sentence, or a jail between 30 and 40 years, and whipping at least 12 strokes of the cane, upon conviction.
All of them were under remand since they faced the charge against them as the charge has no provision for bail.
Deputy Public Prosecutor (DPP) Dana A. Wazani and assisted by DPPs Muhd Yousof Tahir Mahmood, Yuvam Bharathan, and Mohd Haikal Hazwan Md Yatim, conducted the prosecution.
Mohamad Zaki, Mohd Farhan and Mohammad Hasrul were represented by counsel Hamid Ismail while the rest were defended by counsel Chen Wen Jye and Prem Elmer.
