Kota Kinabalu: A 29-year-old paperless Filipino was on Tuesday sentenced to a total of 16 months jail on two counts of having stolen motorcycles.
Amir Kadir pleaded guilty before Magistrate Marilyn Kelvin to committing the offences on Jan 20, this year, at 6.30pm, at the squatter area near Taman Kingfisher, near here.
On the first count, Amir was jailed eight months for having a stolen VF31 185 LE motorcycle belonging to Md Shafie Jamain.
Amir, on the second count, was also handed eight months jail for having a Yamaha 135LC (FI) motorcycle belonging to Willjy Markus.
Each charge under Section 411 of the Penal Code carries a jail term of between six months and five years and liability to a fine, on conviction.
The facts of the case presented by the prosecution stated that Shafie’s motorcycle parked at Kg Likas was stolen on Jan 15 this year.
Amir was arrested by the police on Jan 20 after he was seen acting suspiciously while riding a motorcycle.
A check through the IPRS MYSIKAP RTA revealed that the motorcycle in question belonged to Shafie.
Amir later led the police to the recovery of a Yamaha 135 LC, which had also been reported as stolen.
Unrepresented, Amir requested a lenient sentence.
Inspector Yusdi Basri, prosecuting, applied for the sentence to run consecutively, as the exhibits and the date of the offence were different.
The court ordered Amir to serve the jail terms from the date of his arrest and also to be referred to the Immigration Department thereafter.
In another case, a 32-year-old man was jailed six weeks and fined RM1,000 or jailed four weeks for theft, two years ago.
Fryjilon Bungin pleaded guilty before Magistrate Dzul Elmy Yunus to stealing RM570 cash belonging to Nancy Peter on Aug 12, 2023, between 3pm and 10.11pm, at the Star Café, Lido Avenue.
He was charged under Section 380 of the Penal Code which carries a jail term of up to 10 years jail and liability of a fine, on conviction.
Unrepresented, Fryjilon requested a lenient sentence citing that he is a divorcee with two children and just started working as a cleaner.
Deputy Public Prosecutor Bryan Francis applied for an appropriate sentence.
Meanwhile, a driver was charged with assaulting another person, last year.
Mahady Sham pleaded not guilty to voluntarily causing hurt to Sanjack Gan on May 15, 2024, at 11.46am at the loading bay section of the serving unit of the Queen Elizabeth Hospital 2.
The charge is framed under Section 323 of the Penal Code.
The prosecution proposed bail at RM5,000.
Unrepresented Mahady requested a lower bail as he has family to support.
The court fixed April 15 for pre-trial case management and released the accused on RM1,500 bail in two sureties.
