He was charged under Section 45A(1) of the Road Transport Act (APJ) 1987 (Act 333/87), which carries a penalty of imprisonment for up to two years and a fine of up to RM30,000, if convicted.

Based on the case facts, a Toyota Hiace driven by a 36-year-old man was rear-ended by the Viva driven by Roslan at the Hilltop roundabout while heading towards Tanjung Batu from Kg Sri Menanti.

Initial investigations revealed that the cause of the accident was due to the negligence by Roslan who was suspected of driving under the influence of alcohol.

A check on past criminal records revealed that Roslan was a former OBB under the supervision and monitoring of the Tawau District Parole and Community Services Office, with his license expiring on Feb 9, 2023.

In mitigation, Roslan, who was unrepresented, requested a lighter fine as he was unemployed and had no income.

He also admitted to drinking alcohol at a Christmas celebration at a friend’s house when questioned by the magistrate about where he bought the alcoholic drinks (despite not being employed and having no income).

Traffic Prosecuting Officer ASP Joan Lee urged the court to impose a heavy and appropriate sentence on Roslan due to public interest, as his actions of driving under the influence of alcohol were irresponsible and dangerous to himself and others.
