Kota Kinabalu: Two owners of an entertainment outlet were fined a total of RM10,000 by the Magistrate’s Courts here, Friday, for operating the premiseS without a licence, last year.
Koh Siew Ching, 44, and Hee Kok Khiong, 39, pleaded guilty before Magistrate Dzul Elmy Yunus to committing the offence at the Woozy, Jalan Lintas Plaza here, on Nov 23, 2024, at 11.23pm.
They were found to be manning the business without a valid licence issued under Section 6 (1) of the Public Entertainment Ordinance (PEO) 1958.
The charge, under Section 4 of the PEO 1958 and punishable under Section 11 of the same Ordinance, provides a fine of up to RM50,000 or up to one year jail or both on conviction.
Koh and Hee were each ordered to pay a fine of RM5,000 or five months’ jail.
The prosecution informed the court that the police raided the place on Ops Pusat Hiburan and found IT was in operating with music being played and customers in karaoke sessions.
Investigations based on the licence issued by City Hall revealed that the premises had committed an offence by violating the set conditions, specifically the prohibition on karaoke activities.
Both unrepresented, Koh requested for leniency and asked for another chance, as it was their first time in such a field.
The prosecution applied for a deterrent sentence.
