Sarawak couple freed in RM3 million CBT case
The offence, under Section 409/34 of the Penal Code, carries a jail term of between two and 20 years, and with whipping, and liable to a fine, on conviction.
Kota Kinabalu: A Sarawakian couple charged with committing criminal breach of trust (CBT) by misusing company money amounting to RM3,191.20 was freed from the charge without their defence being called.

Sessions Court Judge Amir Shah Amir Hassan discharged and acquitted Yeo Kwang Seaun and his wife Alicia Lim Ai Hsia, after ruling that the prosecution had failed to establish a prima facie case against the couple.

The couple was accused of committing CBT by misusing company’s money of RM3,191.20 for the same purpose.

Yeo and Lim, as the directors of Syarikat Fucos Trading (Sabah) Sdn Bhd, was accused of committing CBT by misusing the company’s money which had been used to pay the salary of one Sazien Sudin who had resigned from the company in August 2018.

The prosecution had called three witnesses during the hearing.

Deputy Public Prosecutor Nurul Shaheerah Mad Iskim conducted the prosecution while the couple was represented by counsel Serena Liew.
