Kota Kinabalu: A 37-year-old man was jailed seven years for repeatedly taking syabu.
Sessions Court Judge Elsie Primus meted out the sentence to Mohd Fazryzeen Daim who admitted to the charge against him.
He was found taking the drug at 4.30pm on Feb 3, 2024 after testing positive for the drug at the Sipitang police station. Mohd Fazryzeen has one previous conviction records for taking the drug under Section 39C(1) of the Dangerous Drugs Act (DDA).
For the offence, he was charged under Section 15(1)(a) and punishable under Section 39C(2) of DDA which carries a jail term of between seven and 13 years, and whipping at least three lashes, on conviction.
The court ordered Mohd Fazryzeen to serve the jail sentence from the date of his arrest. After completing his jail sentence, Mohd Fazryzeen was ordered to be placed under police supervision for three years.
During mitigation, Mohd Fazryzeen who was not represented, asked for leniency saying that he has two children to look after.
However, Deputy Public Prosecutor Sofiah Sawayan urged the court to impose a deterrent sentence.
