Kota Kinabalu: A 32-year-old woman was fined a total of RM3,000 for having unregistered products and cosmetics without labels.
Sessions Court Judge Amir Shah Amir Hassan handed the sentence to Sitti Safina Jolly who pleaded guilty to the two charges against her on Thursday.
On the first count, Safina was fined RM500 in default 14 days’ jail for having nine types of unregistered products at 11am on Jan 16, 2024 at the Safina Kosmetik in KK Plaza Jalan Lapan Belas, here.
Among the products were Collagen Plus Whitening Beauty, Hydroqwinone Tretinoin Brilliant Rejuv, Surut Ayu, Freshcare Sandalwood and Minyak Linta.
The offence under Regulation 7 (1)(a) of the Control of Drugs and Cosmetic Regulations 1984 carries a jail term of up to three years, or a fine of up to RM50,000 or both, on conviction.
On the second count, she was fined RM2,500 or jailed a month for having 44 types of cosmetics without labels at the same place and time.
During mitigation, the unrepresented Safina asked for leniency, saying that she would not repeat the offence in future.
The prosecution urged the court to impose an appropriate sentence as Safina had committed the offence which could risk the public’s health as the products were not registered with the Health Ministry and without labels.
Meanwhile, a 21-year-old woman was fined RM300 or jailed 14 days for selling three types of unregistered products. Julia Hana Masdullah admitted to selling the products which were not registered with the Health Ministry at the same place and time as Safina.
Prosecuting Officer Abu Suffian A. Rahman from the Pharmacy Department appeared for the prosecution.
