Woman claims trial to RM97,000 Criminal Breach of Trust
The charge is framed under Section 411 of the Penal Code, carries a jail term of between six months and five years and liability of a fine on conviction.
Kota Kinabalu: A 55-year-old woman was charged in the Magistrate’s Court here Friday with committing a criminal breach of trust amounting to RM97,717, last year.

Ho Yung Fong pleaded not guilty before Magistrate Wan Farrah Farriza Wan Ghazali to committing the offence while being a sub-contractor of Kim Fong Canopy Sdn Bhd entrusted with managing the company’s sales proceeds amounting to RM97,717, have committed criminal breach of trust by using the company’s sales funds for her personal benefit.

The offence allegedly committed between June 1, 2024 and Sept 28, the same year, at the Syarikat Kim Fong Canopy Sdn Bhd, Heritage Plaza, Jalan Lintas, here.

The charge under Section 408 of the Penal Code carries a jail term of between one year and 14 years and whipping and liability of a fine if convicted. The court fixed April 23 for mention and released the accused on a bail of RM3,500.

In another case, a self-employed man was charged with having stolen copper cable belonging to a telecommunication company.

Abdul Zaidi Abdul Rahman, 40, claimed trial to having the stolen 80 metres length of copper cable belonging to Telekom Malaysia on Feb 11, this year, at 2.40am, at the roadside near a petrol kiosk in Tanjung Aru.

The charge is framed under Section 411 of the Penal Code, carries a jail term of between six months and five years and liability of a fine on conviction.The prosecution in applying for a pre-trial case management (ptcm), proposed bail at RM5,000 in two sureties.

Counsel Jagnesh Jaya, representing Zaidi, requested a lower bail amount citing that he is married and self-employed. Magistrate Marilyn Kelvin set April 21 for ptcm and offered the accused bail at RM1,300 in two sureties.

Meanwhile, three men were penalised for having syabu.

Walli Joseph, Kaisal and Mohd Syukri pleaded guilty separately to having syabu weighing 1.50gm, 0.10gm and 0.12gm, respectively, last year. Walli was sentenced to 12 months jail, Kaisal and Syukri were handed eight months and nine months respectively from the date of their arrest.

They were charged under Section 12 (2) of the Dangerous Drug Act 1952 provides for a fine of up to RM100,000 or up to five years jail or both on conviction. Deputy Public Prosecutor Muhammad Haikal Hazwan Md Yatin and Inspectors Yusdi Basri and Alia Nuurlysa Adnan prosecuted.
