Unregistered products: Woman fined RM4,000
The offence, under Regulation 7 (1)(a) of the Control of Drugs and Cosmetic Regulations 1984, carries a jail term of up to three years or a fine of up to RM50,000, or both, on conviction.
Kota Kinabalu: A 43-year-old woman was fined a total of RM4,000 for having unregistered products and cosmetics without labels.

Sessions Court Judge Elsie Primus handed the sentence to Ernisah Jumdan who pleaded guilty to the three charges against her.

On the first count, Ernisah was fined RM1,000 or a month’s jail for selling one type of unregistered product which was Hydroquinone Tretinoin Brilliant Rejuv Topical Cream, to a woman.

On the second count, she was fined another RM1,500 or two months’ jail for having eight products which were not registered with the Health Ministry.

On the third count, Ernisah was ordered to pay another RM1,500 fine or spend two months in prison for having 10 types of cosmetics without labels.

During mitigation, Ernisah who was not represented, asked for leniency saying that she would not repeat the offence in future and that it was her first offence.

She informed the court that she has children to look after.

The prosecution urged the court to impose an appropriate sentence as Ernisah had committed the offence which could risk the public’s health as the products did not registered to the Health Ministry and no labels.

Prosecuting Officer Thai Yih Yang from the Pharmacy Department appeared for the prosecution.
