Pushing Syabu: Brothers charged
They were separately charged under Section 39B(1)(a) of the Dangerous Drugs Act 1952, which carries a punishment of either the death penalty or life in prison and whipping with a minimum of 15 strokes.
Kota Kinabalu: Two brothers were charged in the Magistrate’s Court here with drug trafficking.

Ejambery Moss, 45, and Edward Moss, 53, who were brought before Magistrates Marilyn Kelvin and Dzul Elmy Yunus, respectively, were alleged to have committed the offence on Feb 18, at a unit in University Condo Apartment 2, Manggatal.

Ejambery, a labourer, is accused of trafficking 108.53gm of syabu at 2.20pm, in the living room of the unit.

Edward is accused of trafficking 68.50gm syabu at 2.30pm in the second bedroom of the said unit.

No plea was recorded from Ejambery and Edward.

The prosecution applied for another mention date pending the chemists’ reports and proposed no bail as the charge against the accused is non-bailable.

Marilyn fixed April 15 for mention of Ejambery’s case while Edward’s case would be mentioned on April 29.

The accused, who were not represented, were ordered to be further remanded.

Meanwhile, an unemployed man was charged with threatening to kill his former girlfriend.

Unemployed Latip Jamalun, 34, pleaded not guilty to criminally intimidating one Lailatul Marhamah Jasri, on Feb 27, this year, at 6.10pm, at Kg Numbak, Manggatal.

The charge, under Section 506 of the Penal Code, carries a jail term of up to seven years or fine or both on conviction.

The prosecution in applying for a pre-trial case management (PTCM) date, proposed bail at RM5,000 in two sureties.

The accused requested for a lower bail amount.

Dzul Elmy set April 29 for PTCM and released the accused on a bail of RM2,000 in two sureties with a condition not to tamper with the prosecution’s witnesses, especially the complainant.

Inspectors Yusdi Basri and Mohamad Hamidi Mohamad Hamzah prosecuted.
