Selangor man fined for having poisons
The offence under Section 9(1) of the Poisons Act and punishable under Section 32(2) of the same Act.
Kota Kinabalu: A 45-year-old man from Selangor was fined RM1,100 for having poison that has been sent for transportation did not comply with packaging requirements.

Sessions Court Judge Elsie Primus handed the sentence to Lim Bin Bin @ Lim Poh Bin, who admitted to two charges against him.

On the first count, Lim was fined RM500 or spend 20 days’ jail for having Daktarin 15G containing Miconazole which is listed in the First Schedule of the Poisons Act 1952 at 8am on Sept 8, 2021 at the Luyang Post Office, Damai Plaza, Luyang, near here.

On the second count, he was fined another RM600 or jailed 25 days for having Clarinase 24HR containing Loratadine and Pseudoephedrine also poison listed in the First Schedule of the Poisons Act 1952, at the same place and time.

Counsel Prem Elmer Ganasan who represented Lim, requested for no custodial sentence to be imposed and a minimum fine of RM500 for each charge.

Prem told the court that Lim has three children to look after and that it was his first offence.

He informed the court that Lim had no intention of  misusing the products and he was very remorseful.

Prosecuting Officer Lim Lay Peng from Pharmacy Department, urged the court to hand down an appropriate sentence to Lim.

The court heard that a team from Pharmacy Department went to the post office following information from the public that Lim had sent the products containing poisons to the post office but did not comply with the packaging requirements.
