Kota Kinabalu: The Traffic Court here on Tuesday fined a 24-year-old man RM7,000 or seven months jail for careless and inconsiderate driving, last year.
Daniel Chan pleaded guilty before Magistrate Marilyn Kelvin to driving a Perodua Ativa by driving the car without due care and attention to other road users, at the Wisma Muis junction, Jalan Sembulan, on Oct 5, 2024, at 5pm.
Chan was charged under Section 43(1) of the Road Transport Act (RTA) 1987 (Amended 1999) carries a fine of between RM5,000 and RM10,000 and liable to jail of up to 12 months, on conviction.
The facts of the case tendered by the prosecution stated that on the said day, a road accident involving a Proton Saga and a Perodua Ativa occurred near the Wisma Muis intersection.
The driver of the Perodua Ativa, Chan was heading towards Imago Mall from Wisma Muis with two passengers.
As Chan approached the main intersection at Jalan Sembulan, he stopped before making a right turn, observing that vehicles from his right were still at a distance.
However, as he proceeded into the rightmost lane, a Proton Saga travelling straight from the right collided with the side of his vehicle, causing it to spin.
The impact left Chan’s passengers with serious injuries, and were rushed to Queen Elizabeth 1 Hospital for further treatment.
The facts of the case further stated that Chan had committed an offence by driving the car without due care and attention to other road users.
The court also ordered Chan’s driving licence to be endorsed with the details of the conviction.
