Kota Kinabalu: A housekeeping attendant, who threatened to injure his sister, was on Monday jailed eight weeks by the Magistrate’s Court here.
Ahmad Hailmy Abd Rahman, 44, pleaded guilty before Magistrate Dzul Elmy Yunus to criminally intimidating Noor Mizra Abd Rahman, 39, on March 12, this year, at 12.45pm, at a house in Kg Peringatan, Petagas, near here.
Inspector Mohamad Hamidi Mohamad Hamzah informed the court that on the day of the incident, the complainant, who was in her room, heard Ahmad shouting.
Concerned, she went to check and discovered that Ahmad was angry because her son had not taken out the rubbish.
The complainant said it was a minor issue as the rubbish could be disposed of in the morning.
However, Ahmad became furious and lashed out at her, saying, “Kalau kau bukan perempuan, lama sudah aku rembat kau (If you were not a woman, I would have hit you).”
In his rage, Ahmad threw a knife at the complainant and slammed a pestle and mortar onto the dining table.
The complainant managed to dodge the knife, and the situation was eventually de-escalated by her husband.
Ahmad and the complainant lived under the same roof.
She had brought him back to Sabah from the peninsula after his release from prison, hoping he would change his ways and turn over a new leaf.
Fearing for her safety due to Ahmad’s words and actions, the complainant lodged a police report, leading to his arrest.
Counsel Jagnesh Jaya, representing Ahmad, requested a reduced jail sentence starting from the date of his arrest, noting that he had already been in remand for five days.
Jagnesh said that Ahmad is single and works in hotel housekeeping and explained that the incident arose from a misunderstanding between Ahmad and his sister.
Ahmad was remorseful for his actions, he added.
Ahmad confirmed to the court that he had a previous conviction for a drug offence, for which he served five years in Kajang Prison.
Hamidi applied for an adequate sentence.
Dzul Elmy ordered Ahmad to serve the jail sentence from the date of his arrest.
Ahmad was charged under Section 506 of the Penal Code which carries a jail term of up to seven years or fine or both, on conviction.
In another case, a woman was fined RM1,600 or jailed a month for having gambling paraphernalia, last year.
Rose Ansakit pleaded guilty before Magistrate Marilyn Kelvin to having a handphone containing Wahui riddles without a licence on Oct 25, 2024, at 1.50pm, at Kepayan Commercial Centre, Kepayan.
The facts of the case, as presented by the prosecution, stated that a woman, later identified as Rose, was arrested by the police after they discovered that the mobile phone she was holding contained apps used for facilitating Wahui-type gambling activities.
The police also seized RM270 from Rose.
The charge under Section 9(1) of the Common Gaming House Act 1953 provides for a fine of up to RM5,000 or up to six months’ jail, on conviction.
The Magistrate also ordered the RM270 seized and forfeited as government revenue.
Inspector Yusdi Basri prosecuted.
