Kota Kinabalu: A 31-year-old woman was on Tuesday freed by the High Court here from a charge of trafficking 3,829.9gm of syabu.
High Court Judge Datuk Celestina Stuel Galid discharged and acquitted Asmah Jinnur without her defence being called.
Celestina in her ruling held that the prosecution had failed to establish a prima facie case against the accused.
Asmah was accused of committing the offence on July 23, 2019, at 12.12am in a house, Lorong Rimba 2, Taman Rimba, Bandar Sierra, Manggatal.
Asmah had on Jan 17, 2022 claimed trial to the charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952.
The charge carries a punishment with either the death penalty or life in prison and whipping with a minimum of 15 strokes, on conviction.
Asmah, who was represented by counsel Dominic Chew Ban Huat, has since been held under remand as the charge against her has no provision for bail.
Four prosecution witnesses were called to testify in the two-day trial commencing on Feb 18, this year.
