Kota Kinabalu: A 33-year-old labourer was sentenced to eight months in prison on Wednesday for threatening to harm his wife and their seven-year-old son after refusing his demand to follow him on foot to return to Kota Belud.
Jimmy Edward pleaded not guilty before Magistrate Marilyn Kelvin to committing the crime against his 29-year-old wife on Feb 14, this year, at 6.20pm, in a house at Kg Bambangan, Inanam.
Jimmy, whose case came up for pre-trial case management (ptcm) on Wednesday changed his plea to guilty to the charge under Section 506 of the Penal Code which carries a jail term of up to seven years or a fine or both, on conviction.
The facts of the case presented to the court by the prosecution stated that on the said day, Jimmy’s wife was at his sister’s house when Jimmy, who was intoxicated, arrived and insisted on taking his wife and their son back to Kota Belud on foot.
However, Jimmy’s wife and sister tried to stop him, and in the ensuing situation, Jimmy was enraged and threatened his son, saying: “Saya akan pukul kau dengan besi kalau kau tidak mahu ikut saya (I will beat you with an iron if you don’t want to follow me).”
Jimmy also threatened his wife by saying: “Saya akan pukul kau dan buang kau di longkang kalau kau tidak mahu ikut cakap saya (I will beat you and throw you into a drain if you don’t do what I say)”.
The wife then lodged a police report against Jimmy.
Police investigations revealed that the complainant and Jimmy, along with their son, had come to Kota Kinabalu for her hospital review appointment regarding a previous arm injury.
It was also revealed that Jimmy had one conviction record for a drug-related offence.
In another case, a female shop assistant was fined RM2,000 or jailed three months for assaulting a man.
Remmi Abdul Rahman, 25, admitted to voluntarily causing hurt to Muhd Ruhaiezal Jairul Shah, 29, on Jan 30, this year, at 8.15pm, on the roadside of Kg Gudon, Manggatal.
Charged under Section 323 of the Penal Code, Remmi’s case came up for ptcm in which he informed the court of his wish to plead guilty to the charge which carries a jail term of up to one year or with a fine of up to RM2,000 or both, on conviction.
The facts of the case presented by the prosecution stated that Remmi, who was driving a car, suddenly stopped in front of the victim’s motorcycle, confronted and punched him once in the face.
After assaulting the victim, Remmi said to him: “Nanti jumpa di court (See you in court later)”, before speeding off, leaving the victim with an injury and bruising.
Feeling threatened by Remmi’s words, the victim, who received outpatient treatment at the hospital, lodged a police report.
Remmi was later arrested by police on last Jan 10 after a check on his car registration number through MySikap JPJ.
