Murder accused to stand trial
The offence is framed under Section 323 of the Penal Code.
Kota Kinabalu: Two men, who were charged with the murder of an undocumented man in Penampang, two years ago, will go on trial in September this year.

High Court Judge Datuk Dr Lim Hock Leng fixed Sept 22-26 and Oct 13-16 for the trial of the accused, Mohd Hazrul Migo Masan, 32, and Najib Adam, 31, who were charged under Section 302 of the Penal Code.

Hazrul, a storekeeper and Najib were jointly accused of murdering Al Sam Amil along with seven other accomplices, who are still at large on Dec 24, 2023, between 4.44am and 6.42am, by the roadside of Jalan SMK Bahang.

The charge against them carries a sentence of either the death penalty or imprisonment for not less than 30 years but not exceeding 40 years and if not sentenced to death, shall be punished with whipping of not less than 12 strokes for male convicts below 50 years of age, on conviction.

In another case, a man was charged in the Magistrate’s Court with assaulting an individual.

Aser-Arapat Abilol Taulani pleaded not guilty before Magistrate Dzul Elmi Yunus to voluntarily causing hurt to Tan Ai Ping on April 12 in Penampang.

Prosecuting Officer Inspector Mohamad Hamidi Mohamad Hamzah informed the court that the accused has a valid passport and proposed bail at RM4,000.

Counsel Lim Ming Zoong @ Lawrence, representing the accused, requested a lower bail amount.

The court set June 16 for pre-trial case management, released the accused on bail of RM1,800 in two sureties, and ordered him to report to the police station twice a month.
