Kota Kinabalu: The decision in the case of a contractor and his now former wife, accused of murdering their maid four years ago, has been adjourned to May 16.
Defence counsel Datuk Seri Rakbir Singh, who represented the second accused, Etiqah Siti Noorashikeen Mohd Sulong, informed the media that the High Court had fixed a new date for clarification and decision.
Rakbir said he had filed a further submission on the issue of similar fact evidence, arguing that the similar fact evidence was not rebutted.
He added that the judge had directed the prosecution and counsel for the first accused to respond, if necessary and set the new date.
Mohammad Ambree Yunos @ Unos, 43, and Etiqah 36, are accused of murdering one Nur Afiyah Daeng Damin, 28, between Dec 8 and 11, 2021, at a unit in Amber Tower, Lido Avenue Condominium, Penampang.
They were jointly charged under Section 302 of the Penal Code, read together with Section 34 of the same Code, which carries the death penalty or a prison term of no less than 30 years jail and not more than 40 years jail, along with no fewer than 12 strokes of the cane, on conviction.
Ambree was represented by counsel Datuk Ram Singh. Both accused remain on court bail.
Meanwhile, in the Magistrate’s Court, a 33-year-old man was fined RM3,500 or five months’ jail for stealing communication cables.
Jieben Abd Mahadi pleaded guilty before Magistrate Dzul Elmy Yunus to committing mischief by cutting cables belonging to Telekom Malaysia along an accomplice still at large on Feb 6, this year, at 4.10am, near a fuel kiosk at Kobusak Penampang.
He was charged under Section 431A of the Penal Code, which carries a jail term of up to two years or fine or both, on conviction.
The court heard that Jieben was arrested by a Telekom patrol unit after he was found acting suspiciously, and after a search on him, found several lengths of cut underground copper cable with him.
In another case, a 24-year-old self-employed was fined RM1,500 or three months jail for disposing of stolen property.
Mohd Nurnazri James pleaded guilty to committing the offence on a stolen gold coin belonging to one Md Kamil Marbasa on Jan 8, this year, at 12 noon, at a shop in City Mall near here.
He was charged under Section 414 of the Penal Code which carries a jail term of up to seven years or fine or both, on conviction.
Duty counsel Lim Ming Zoong @ Lawrence, representing Nurnazri, requested a lower fine citing that he is married with one child.
Inspector Mohamad Hamidi Mohamad Hamzah prosecuted.
