Kota Kinabalu: A 33-year-old Filipino construction worker, who was charged with the murder of his wife in the city centre, three years ago, will go on trial in July, this year.
High Court Judge Datuk Celestina Stuel Galid fixed July 21-25 and July 28 - Aug 1 for the trial of Nul Sadam Jems.
Nul, who holds an IMM13, claimed trial for committing the crime against one Nasfidah Japarah, 22, between 10pm and 11.47pm on March 22, 2022 in a rented room, on the third floor, Block J, Segama.
The offence under Section 302 of the Penal Code carries a sentence of either a death penalty or imprisonment for not less than 30 years but not exceeding 40 years, and if not sentenced to death, shall be punished with whipping of not less than 12 strokes for male convicts below 50 years of age, on conviction.
Nul was ordered to be further remanded as the charge against him has no provision for bail.
He was represented by counsel Jamadi Saleh.
In another case, a 29-year-old man was charged in the Magistrate’s Court with cheating a woman of RM52,000 over a Native title land sale agreement.
Land broker, Ardi Acho was accused of cheating one Mahani Amirhussin by deceiving her into believing he was legitimately selling a piece of Native Title land in Indai, Tuaran, under a sale and purchase agreement dated Jan 5, 2024, which led her to transfer RM52,000 to his CIMB bank account, an action she would not have taken had she not been misled.
The offence allegedly took place on Jan 5, 2024, at 12 noon at a law firm in Bundusan, Penampang.
However, no plea was recorded from Ardi, after the charge under Section 420 of the Penal Code was read out to him before Magistrate Dzul Elmy Yunus via Zoom.
The court fixed May 14 for mention and released the accused on a bail of RM2,800 in one surety.
In another case, a 20-year-old man was charged with failing to explain a cash deposit into his bank account.
Mohamad Arshad was accused of failing to explain the source of RM14,600 deposited into his bank account on Feb 2, this year at 11.49pm, in Penampang.
However, no plea was recorded from the accused after the charge was read out to him.
The charge under Section 22A(1) of the Minor Offences Ordinance provides for a fine of RM100 or up to three months jail or both, on conviction.
The Magistrate set May 9 for mention of the case and released the accused on a bail of RM500 in one surety.
