Kota Kinabalu: A 45-year-old man, who has a conviction record of taking drugs, was jailed eight years and ordered given four strokes of the cane for committing a similar offence.
Darkasim Sidik pleaded guilty before Sessions Court Judge Amir Shah Amir Hassan to taking syabu and amphetamine at 1pm, on April 10, this year, here.
The charge against Darkasim also stated that he had one previous conviction under Section 39C(1)(b) of the Dangerous Drugs Act (DDA) 1952.
Darkasim was charged under Section 15(1)(a) of the same Act and punishable under Section 39C(2) of the same Act, which carries a jail term of between seven and 13 years and whipping between three and six lashes, on conviction.
Darkasim, who was not represented, requested a lenient sentence.
The court noted that Darkasim had previously been sentenced to five years in prison after being convicted by the Sessions Court for an offence under Section 39C(1)(b) of the DDA 1952.
Darkasim informed the court that he had only been released from prison on Oct 11, 2024, and was arrested in April this year for a similar offence.
When asked by the court why he could not stop taking drugs, Darkasim replied: “It is hard to explain”.
The court ordered him to serve the sentence from the date of his arrest and be placed under police supervision for three years thereafter.
